Understanding property law in North Cyprus
Property ownership in North Cyprus is governed by local land registry laws and regulated through official registration procedures. Ownership rights are secured through contract registration and title deed transfer at the Land Registry Office.
Property in North Cyprus is subject to two competing legal frameworks: TRNC land registry law, which governs registration and transfer locally, and Republic of Cyprus law, which is recognised internationally and does not accept TRNC records for pre-1974 Greek Cypriot owned land. Both must be understood before buying.

TITLE CATEGORIES
Title deed categories and why they matter
Every property in North Cyprus falls into one of several title categories, and the category determines the legal and resale risk more than any other single factor.
Pre-1974 Turkish title
Land registered to Turkish Cypriot owners before 1974. Lowest risk category.
Foreign title
Land registered to foreign nationals before 1974. Comparable risk profile.
Eşdeğer (Exchange) title
Issued to Turkish Cypriots in exchange for property they left in the south. The underlying land was Greek Cypriot owned before 1974.
TMD / Tahsis (Allocation) title
Land allocated by the TRNC authorities, typically to settlers from Turkey. The underlying land was Greek Cypriot owned before 1974.
Buyers must establish the category in writing before signing anything. Any property in the eşdeğer or TMD/tahsis categories carries additional legal exposure, because the Republic of Cyprus does not recognise TRNC records for land that was Greek Cypriot owned before 1974.

Who the contract is with
Neither the property purchase agreement nor the rental income agreement is a contract with Limitless Real Estate. Both are direct agreements between you and the developer or construction company.
What Limitless does
Limitless Real Estate handles sales and marketing only — introducing you to the opportunity, answering questions and guiding you through the process. Limitless is not a party to the purchase contract and has no involvement in payments of any kind: it does not collect, hold, process or receive any purchase or rental payment at any stage.
Why this structure protects you
All purchase payments and all rental income flow directly between you and the developer, under the agreements you sign with them. Because the contract and every money movement sits with the established company that actually builds the property and pays the rental income, you keep a direct legal relationship with the responsible party — no intermediary in between.
What this means practically
The purchase agreement is signed directly with the developer, and rental income is paid directly by them under that same agreement. Any question about payment terms, timelines or contract clauses should be directed to the developer or verified against your signed agreement. We strongly encourage independent legal advice before signing.

Acquisition limits (in force since 15 May 2025)
A foreign national may acquire one of the following:
- Land with a building permit: maximum 1,338 m², on which only one dwelling may be built
- Up to 3 apartments
- One detached house on a plot of maximum 3,300 m², with no second dwelling permitted on the plot
- On mass housing or site developments: up to 2 two-storey detached villas
No more than 80% of the apartments in a single development may be sold to foreign nationals. Agricultural and forestry land cannot be acquired by foreign nationals. A TRNC-registered company counts as a foreign legal entity if any of its shares are held by foreign persons, regardless of percentage, or if the majority of its directors are foreign.
Trustee arrangements, under which a foreign buyer holds property through a TRNC citizen, are no longer permitted. Agreements made before 21 May 2024 had to be registered at the District Lands Office to remain valid.

AFTER APPROVAL
After Permission to Purchase is granted
75 business days for taxes and fees
All taxes and fees must be paid within 75 business days of the Council of Ministers' permission being published in the Official Gazette. Failure to pay results in automatic cancellation of the permission.
1 year for title deed transfer
The title deed transfer must be completed within 1 year of publication. Where payments under the contract are still outstanding, the 1-year period runs from the final payment.
No utilities before taxes are paid
Until the taxes are paid, no permanent electricity or water connection will be granted. Construction-site connections are excluded.

Why contract registration is critical

Missing the 21-day deadline can expose the parties to penalties and leaves the buyer without registered priority against third parties.

OFF-PLAN
Legal structure of off-plan purchases
Title deed requirement: since 21 May 2024, foreign nationals cannot purchase property on a shared title deed (hisseli). The property must carry an individual title deed or a condominium easement deed (kat irtifakı). Contracts concluded on shared deeds are void. Where a kat irtifakı deed is not yet available, an application for Permission to Purchase may be made within two years from 15 May 2025, provided the property has a valid building permit or planning approval.

TAX COMPLIANCE
Taxes in the legal process
Title Deed Transfer Fee
Foreign nationals: 9% of the assessed value (reduced from 12% on 15 May 2025). Where the contract of sale is registered before title transfer, the fee is split: 6% on registration and 3% on transfer for a first property; 3% on registration and 6% on transfer for a second or third property. TRNC citizens pay 6%, with a one-time right to a reduced 3% rate. Turkish citizens pay 6% / 8% / 9% for first, second and third properties.
Stamp Duty
0.5% of the contract price, payable to the Tax Office within 21 days of signing the Contract of Sale. The contract cannot be registered at the District Lands Office until stamp duty is paid.
VAT (KDV)
5% of the contract price where the vendor is a professional vendor or developer. Typically payable on delivery of possession, against an official invoice (fatura). Confirm in the contract who bears VAT and when it falls due.
Capital Gains Tax (Stopaj)
Payable by the seller on resale. Commonly cited rates are 6.25% for professional vendors and 3.5% for private individuals, but rates are adjusted periodically and must be confirmed with a lawyer at the time of sale.
Transformer / Infrastructure Contribution
A one-off contribution payable to the developer or utility provider before permanent electricity connection. Commonly in the range of £1,500 to £3,000, but project-specific.

Bank financing for foreign buyers in the TRNC is limited in availability and typically carries high interest rates and short terms. Most foreign purchases are financed through developer payment plans. Foreign banks generally do not lend against TRNC property.

- Is buying property in North Cyprus legally secure?
- Within the TRNC legal system, registration of the contract and transfer of an individual title deed give the buyer enforceable rights. However, the TRNC is not internationally recognised, and the Republic of Cyprus asserts criminal jurisdiction over transactions involving property that was Greek Cypriot owned before 1974.
